Upholding the Sacred Oath of Office
People in America choose to become candidates and run for elected office knowing they will swear allegiance to the United States Constitution through this sacred oath. America is NOT a Democracy. The governments in America are not and were never founded as “democracies.” America and every state within these United States are founded as Republics, and these Republics are limited in their power and authority by and through the Constitution of the United States and the Constitution of the respective state.
Once the election is over, the “democracy of majority rule” is over, the Republic, and the limits the Constitution places on government authority are to be upheld by the candidate who won the election. If an elected official fails to uphold their oath and sponsors and/or votes in support of any legislation that is in violation of the United States Constitution that elected official has violated their oath and committed treason. See the United States Supreme Court decision – Cohens versus Virginia, “to war with the Constitution is treason.”
When those holding positions of power within our government do not possess the courage and integrity to uphold this sacred obligation and instead violate their oath, they quite literally spit on the sacrifices our military members make under the same oath “to support and defend the United States Constitution.” Military members die while the political classes lie. While a military member that fails to uphold the oath can be charged and sentenced to prison and/or even death, there seems to be no consequences for those holding political power.
Every American that is being subjected to unconstitutional laws and acts by our government officials must have the authority to hold elected officials as personally responsible as are military members are held. Our elected officials attempt to pass legislation promoting the false idea that they themselves can create a magic vest which gives them “qualified immunity” shielding them from any and all punishments for violating their sacred oath to the same Constitution our military members give their lives to support and defend.
However, the United States Supreme Court decision Henry Thompson versus City of Kansas City attests that “qualified immunity is lost when any individual violates your constitutionally protected rights through intent and/or incompetence” and therefore elected officials are NOT and CANNOT shield themselves from personal accountability when they sponsor, support, vote for and/or enact laws, statutes, regulations and/or ordinances that violate the United States Constitution, because violating the Constitution is an act of treason. Politicians can no more enact legislation to insulate themselves from the consequences of their acts of treason against the Constitution than a military member would be able to waive a magic wand and absolve their self of an act of treason.
A person living within the district of the political candidate who chooses to run for and wins a position within a government office must be able to use civil lawsuits to hold that elected official personally responsible when that official violates their oath “to support, defend and obey the United States Constitution” just as you would have the right to use a civil lawsuit to hold your neighbor responsible when the neighbor is violating your constitutionally protected rights.
Let’s understand this fully by putting it in very clear contrast. Elected officials cannot enact laws preemptively protecting themselves from lawsuits if they were to commit murder, bank robbery, rape, extortion, kidnaping and other laws that protect the God-given rights of each individual. So, lawmakers cannot enact laws protecting themselves from lawsuits when they violate their oath and sponsor, support and/or enact measures that violate the God-given constitutionally protected rights of any American.
Don’t get confused, elected officials are either honest Patriotic constitution-loving Americans with the integrity and courage to uphold their oath to the Constitution, or they are traitorous trash who are committing treason.
